Let Freedom Ring!

Justice Scalia is a demi-god, and the Gang of Four never fail to demonstrate their totalitarian mindset.

We are aware of the problem of handgun violence in this country, and we take seriously the concerns raised by the many amici who believe that prohibition of handgunownership is a solution. The Constitution leaves the District of Columbia a variety of tools for combating that problem, including some measures regulating handguns, see supra, at 54?55, and n. 26. But the enshrinement of constitutional rights necessarily takes certain policy choices off the table. These include the absolute prohibition of handguns held and used for self-defense in the home. Undoubtedly some think that the Second Amendment is outmoded in a society where our standing army is the pride of our Nation, where well-trained police forces provide personal security, and where gun violence is a serious problem. That is perhaps debatable, but what is not debatable is that it is not the role of this Court to pronounce the Second Amendment extinct. We affirm the judgment of the Court of Appeals.

It is so ordered.

Justice Kennedy decided to join the right side this time. Just by chance, perhaps the liberal pro-totalitiarian members lost the coin toss. Every decision might as well be up to him alone. The Supreme Court of The United Staes is a star chamber. It will be the end of US.

Thank You! I can't believe one of the anti-gun Judges said the founders never intended to limit the Governments ability to control guns...lol

Hey guys check this out. I have been in many Iraqi homes, vehicles and businesses over the last year. I have yet to see one without a gun inside. When I say gun, I mean AK-47, full auto. They are allowed to have them. Most of these people are so non-violent and law abiding it is amazing. Not to mention extremely polite to each other and foreigners. The violence you read about in the news is related to the insurgency and has nothing to do with the weapons which they had rights to BEFORE the war. So we are over here fighting for Iraqis to have rights we can't enjoy in most of our own country. Go figure.

Jeff_F_F    Just the opening battle   6/26/2008 7:23:04 PM
This is a huge victory. But it is not the end, only the beginning. It is the initial breakthrough that must be exploited. The next battle is a policy one. The key will be to watch home robbery rates (theft from occupied homes) drop in comparison to home burglary rates (theft from unoccupied homes) in DC and the other cities presumably soon to be effected by the ruling. When this happens (as it no doubt will) then the next step is to educate the people of these cities that the change is a direct result of criminals new found respect for their now potentially legally armed victims in the home. Then to make the case that that respect needs to extend to them in all aspects of their life, not just in the home and that what is needed is removing the restrictions on ownership outside the home and eventually passing shall-issue concealed carry laws. Sad that we need to educate people--to convince them--that they need to take their rights back, but we do.

Kurdistan, too. I think it has to deal with the fact that they know who their enemies are and have no problem saying.

Many people in the U.S view crime as some kind of mythical monster from the hillsides. Or maybe there's a sort of PC element to it, when we say our cities or neighborhoods are "getting bad" and don't want to specify further. How exactly is it getting bad? Climate change? The wind?

Crime and violence isn't the weather. It's caused by people. Human beings.

I've grown so tired of the logic (nonsensical) that some people hide behind when it comes to the topic of guns. To take a mayor of SimCity view, if crime is increasing then legal gun ownership, registration, and training should be increasing. That's my faulty logic, anyway.

RockyMTNClimber    Some more thoughts.....   6/26/2008 9:32:58 PM
After reviewing the decision and reading it from a couple of sources the real meaning of the Second Amendment today now seems to be the following: "The right to keep a gun (even a handgun) inside of your house shall not be unreasonably limited". The decision was a bit anemic in my opinion. Where in the original wording does right of self defense end with your doorstep?

The fact that the decision hangs by a thread (what if Obama gets the opportunity to replace one of the conservatives?) is very concerning to me, but I should take solice that at least this is a start. The people of D.C. can at least excersize a very small percentage of one of their rights in the not so near future.

A narrow victory. 4 learned justices voted against. No surprise then that 2 believe international law influences their decision process.

Old Grunt    Unfortunately...   6/27/2008 7:29:58 AM
nothing will be changing.
Mayor Fenty has already said that while handguns cannot be banned, they can be controlled.  The stated plan is to prohibit the ownership of automatic and semi-automatic handguns, and restrict caliber size to .22 or less.  Also it is illegal to transport a firearm across the district lines if it was purchased in another jurisdiction.  I'm sure that will not be repealed.  Want to take a guess on how many federally licensed places in DC from which you could purchase a firearm? ... Correct!! ZERO!!!  And while the right to keep and bear arms is now agreed to exist within the Constitution, the right to sell them is not, so don't expect to see any business permits issued.  So what it boils down to is that while you can now legally own a handgun in DC, it has to be a small caliber revolver or single shot , you can't bring it here from somewhere else, and there's nowhere here that you can buy one.

Along the lines of how I was looking at this. It disgusts me that only 5 of the highest supposed (in theory anyway) Constitutional authorities ruled to affirm that the Constitution actually means what it so explicitly says.

"The case, which reached the Court as Heller vs. The District, is a special tribute to the foresight and conviction of one man, Robert Levy. Mr. Levy, who has never owned a gun, structured and financed the case, selected the plaintiffs, recruited the lawyers and developed the strategies that led to today's decision. At leaset initially, he did so against the wishes of the pro-Scond Amendment establishment, much of which believed at the beginning of the case, before the elevation of Roberts and Alito to the Court, that the risks as too large.
